The Accra High Court has thrown out Minority Leader Ato Forson’s application for a mistrial and an investigation into the Attorney General’s conduct in the ambulance case, citing a lack of legal basis and insufficient evidence to support his claims. On June 3, Dr. Ato Forson submitted an additional affidavit to reinforce his request for a mistrial, injunction, or suspension of the ongoing ambulance case proceedings against him and two co-defendants.Attorneys for Dr. Ato Forson referenced a leaked audio recording allegedly capturing Attorney-General Godfred Yeboah Dame attempting to influence the testimony of co-defendant Richard Jakpa to incriminate Dr. Forson, as evidence in support of their mistrial motion. The Minority Leader emphasized that if a mistrial is not declared in this case, where the Attorney-General has seemingly flouted legal rules and ethical standards, it may gravely erode public trust in the justice system, undermining its integrity and credibility. In court today, Thursday June 6, Justice Afia Serwah Asare-Botwe rejected the request for a mistrial, stating that Dr. Ato Forson’s legal team failed to provide sufficient grounds for a mistrial and did not adequately investigate the Attorney-General’s alleged misconduct.Justice Afia Serwah Asare-Botwe ruled that the request for an investigation into the alleged late-night phone calls between the Attorney-General and Richard Jakpa lacks legal merit and cannot be granted.
