The High Court is set to deliver its final ruling on the mandamus application filed by the New Patriotic Party (NPP) against the Electoral Commission (EC) on Wednesday, January 1.
Justice Forson Agyapong, who presides over the case, is expected to issue the conclusive judgment.
The application stems from disputes surrounding recent parliamentary elections in four constituencies, prompting legal action from the National Democratic Congress (NDC).
On December 31, the NDC challenged the High Court’s jurisdiction to hear the NPP’s mandamus application.
The NDC’s Head of Legal Affairs, Godwin Edudzi Tamakloe argued that the application sought to contest the validity of the election results using an improper approach. He explained that under sections 16 and 20 of the Representation of People Law, PNDCL 284 (as amended), election results can only be contested through a petition.
Tamakloe further contended that attempting to challenge the results via a prerogative writ like mandamus circumvents the proper evidentiary process required for a fair hearing.
