High Court dismisses Torkornoo’s review application

The Human Rights Division 1 of the Accra High Court has dismissed a judicial review application filed by suspended Chief Justice Gertrude Torkornoo.

The ruling stated the application constituted an abuse of court processes and was brought before a court lacking proper jurisdiction.

Justice Torkornoo had sought to halt impeachment proceedings initiated under Article 146 of the 1992 Constitution, arguing that the process infringed on her fundamental human rights.

Her legal team filed for certiorari a rare procedural remedy, hoping to overturn the impeachment, which she claims is unconstitutional and politically motivated.

This latest legal setback follows the dismissal of three injunction applications at the Supreme Court, all intended to pause the impeachment until constitutional interpretation on the removal of a sitting Chief Justice could be rendered.

In its ruling, the High Court emphasized that it could not override constitutional procedures reserved for Parliament and the Presidency.

The judge underscored that the application sought intervention in a matter strictly outside the court’s jurisdiction and added that it misused judicial review provisions.

Meanwhile, the impeachment proceedings continue under the Justice Pwamang Committee, with intense public scrutiny and national debate swirling around judicial independence and constitutional reform.

Justice Torkornoo has also taken her fight to the international stage, filing a case at the ECOWAS Court of Justice, where she is demanding $10 million in damages for alleged human rights violations.
