The Supreme Court has without exception ruled that the Presidential order asking former Auditor-General Daniel Domelevo to take leave was unlawful.

The court mentioned that the President’s decision to appoint an Acting Auditor General when there was a substantive Auditor-General was seen as illegal.

In July 2020, the Presidency asked the then Auditor General to proceed on leave.

His leave was further extended from 123 days to 167 days starting July 1, 2020 when Mr. Domelevo pointed out that this was illegal.

The Attorney General was sued over these orders by nine civil society organizations.

The Ghana Integrity Initiative (GII), the Citizen Movement Ghana, the Africa Center for Energy Policy (ACEP), and the Parliamentary Network Africa were among them.

They argued that because the President lacks the authority to impose such disciplinary measures on autonomous entities, the orders were not legitimate.

Although Mr. Domelevo has since retired, the Court decided not to issue any additional restrictions preventing him from taking leave.

Justices Emmanuel Kulendi, Prof. Ashie Kotey, Mariama Owusu, Getrude Torkonoo, Lovelace Johnson, Prof. Henrietta Mensah Bonsu, and Nene Amegatcher heard the case.
