NDC files lawsuit to prevent re-collation of Parliamentary results

The National Democratic Congress (NDC) has filed a lawsuit to prevent the Electoral Commission (EC) from re-collating and redeclaring parliamentary election results in Dome-Kwabenya, Okaikwei Central, Ablekuma North, Tema Central, and Obuasi East constituencies.

The NDC asserts that the EC has no legal authority to revisit results that have already been declared. This legal move comes amid disputes over the initial collation process, which the EC invalidated for four constituencies, Dome-Kwabenya, Okaikwei Central, Ablekuma North, and Tema Central—citing procedural irregularities.

According to Samuel Tettey, the EC’s Deputy Chair for Operations, the invalidation was due to non-compliance with procedures outlined in CI 127. He added on December 13 that the police were on standby to ensure a smooth re-collation process.

However, the NDC and five applicants, including candidates Faustina Elikplim Akurugu, Baba Sadiq, Ewurabena Aubynn, Ebi Bright, and Samuel Aboagye, maintain that the EC has overstepped its mandate. The party is seeking a court order to prevent the EC from re-collating, recounting, or redeclaring the results.

Their motion also requests a declaration that the EC no longer has the authority to alter the parliamentary results for the affected constituencies.
