Mahama must be careful –NPP National Organizer

The National Youth organiser of New Patriotic Party, Henry Nana Boakye, affectionately known as Nana B, has described the Suspension of the Chief Justice as a threat to judicial independence.

According to him, the New Patriotic Party profoundly disaproves and vehemently condemns this blatant disregard for constitutional order, judicial santity, and democratic norms.

Speaking at the save the Judiciary Demo media engagement at NPP’S headquarters in Asylum down in the Greater Accra Region, Nana B emphasized that the action taken by the Mahama led administration under the pretext of Article 146 of the 1992 constitution constitutes a great threat to judicial independence, reckless abuse of Executive discretion and an affront to the rule of law.

He added that the Npp does not only consider this unconstitutional but procedurally fraudulent, politically motivated, and executed with alarming disregard for the sanity of due process.

“Article 146 clearly stipulates that the President has no direct authority to suspend or remove a sitting Justice of the Superior Court, including the chief Justice without recourse to an independent investigative mechanism”.

In such matters the president is merely a transmitting agent not a judge, prosecutor, a decision maker, therefore his Suspension of the Chief Justice is ultra violence, unconstitutional and must be rescinded without any delay, he stressed.
