The Supreme Court is set to hear an injunction application today, Wednesday, May 28, 2025, filed by suspended Chief Justice Gertrude Araba Esaaba Sackey Torkornoo, seeking to halt proceedings by the committee probing petitions for her removal.
The five-member inquiry committee, established by President John Mahama, has faced legal resistance from Justice Torkornoo, who argues that its composition violates constitutional provisions.
She filed the interlocutory injunction on May 21, 2025, asking the Supreme Court to restrain the committee from continuing its work until the matter is finally determined.
Justice Torkornoo is also challenging the inclusion of Supreme Court justices Gabriel Scott Pwamang and Samuel Kwame Adibu-Asiedu as committee members, citing potential conflicts of interest.
“Justice Pwamang has previously adjudicated cases involving one of the petitioners, Daniel Ofori, and should therefore be prohibited from participating,” she stated in her affidavit.
Additionally, she argued that Justice Adibu-Asiedu presided over a related injunction application, compromising his neutrality in the current case.
Justice Torkornoo further raised concerns regarding the eligibility of the remaining committee members, Daniel Yao Domelovo, Major Flora Bazwaanura Dalugo, and Prof. James Sefah Dzisah, under Articles 146 (1), (2), (4), 23, and 296 of the Constitution, as well as the Oaths Act, 1972.
In a supplementary affidavit filed on May 26, she asserted that her fundamental rights were being violated, stating, “I respectfully seek leave of this Honourable Court to bring to its attention various developments that evidence a complete desecration of my basic constitutional rights to a fair trial, violation of my dignity, and subjection to inhuman and degrading treatment.”
Meanwhile, the Attorney-General has opposed her claims, insisting there is no legal basis to disqualify Justices Pwamang and Adibu-Asiedu from the inquiry.
“Justice Adibu Asiedu did not participate in the injunction hearing and therefore cannot be barred”.
