Former Chief Justice Gertrude Araba Esaaba Sackey Torkornoo has filed a judicial review at the High Court, challenging her removal from office by President John Dramani Mahama.
In her application, Justice Torkornoo contends that the President’s September 1, 2025 warrant violated Article 146 of the 1992 Constitution, which requires an independent inquiry before a Superior Court judge can be removed.
“The President has no authority to bypass the constitutionally mandated process,” her legal team argued.
She is asking the court to declare the removal “unlawful, null, void, and of no effect,” insisting that only a body established under Article 146(4) has jurisdiction in such matters.
The case, The Republic v. Attorney-General, Ex Parte Justice Gertrude Araba Esaaba Torkornoo, is expected to test the scope of presidential powers and reaffirm the principle of judicial independence in Ghana.
