Side Chick Case: Banker seeks dismissal of sexual harassment case by former NSS personnel

Banker Ernest Kwasi Nimako and his lawyers have filed a motion for the dismissal of the sexual harassment case against him by Deborah Sayram Adablah.

On May 17, 2023, the motion was filed with the purpose to strike out sexual allegations among others filed by former national service personnel.

Attorneys for Mr. Nimako informed the court during a hearing on Tuesday, August 15, before Her Ladyship Abena Amponsah Buansi, a judge on leave. Three motions are still pending.

His attorneys claim that in addition to their request to have the Plaintiff’s pleadings dismissed, applications for contempt were also submitted on June 6 and another from the Plaintiff on June 16 appealing court orders for the surrender of the disputed car.

However, Mr. Nimako’s attorney claimed that their request for the Plaintiff’s pleadings to be thrown out and dismissed takes precedence over the other two requests and that they should be heard first.

Attorneys for Adablah, the plaintiff, concurred with Mr. Nimako’s counsel.

As a result, Justice Buansi, the vacation judge, instructed the parties to return to the substantive judge to handle the case once that was established.

The matter has since been postponed until the new legal year’s deadline on October 15. Mr. Nimako was present, but Adablah wasn’t.

Earlier this year, Adablah dragged Mr Nimako, who was the Chief Finance Officer at First Atlantic Bank at the time, to court.

Her charges against him were that Mr Nimako, who is the first defendant, was asked to fulfil his promise by refunding some 10,000 Ghana cedis to her. She demanded he paid a lump sum of money for her to venture into business as promised her.

She further asked that she is made the owner of the car the bank seized, adding that he pays the remaining accommodation fee and other medical expenses which resulted from side effects of her family planning treatments.
