Wrongful imprisonment: Security Expert calls for state accountability

A Security Expert, Richard Kumadoe has shed light on the critical issue of wrongful imprisonment and the legal recourse available to individuals who have been unjustly detained or imprisoned despite court orders mandating their release.

In an interview with Happy Kaseɛbɔ, Richard Kumadoe cited the disturbing incident at Koforidua Prisons, where an individual was held for six years despite a court order for their release, Mr. Kumadoe emphasized the grave violation of the individual’s fundamental rights by the police officer’s actions. Mr. Kumadoe stressed that in such cases, the individual has the unequivocal right to sue the state for damages, given that the police officer, as a state agent, acted on behalf of the state. He further underscored the imperative for the state to acknowledge and accept responsibility for the officer’s actions, which constitutes a clear breach of the individual’s rights.

Mr. Kumadoe also seized the opportunity to urge the state to take proactive measures to prevent similar incidents from occurring in the future. He advocated for regular and thorough reviews of inmate dockets to ensure that individuals are not unjustly detained and that court orders are promptly enforced. By doing so, the state can uphold its commitment to justice, protect the rights of citizens, and prevent unnecessary suffering and hardship.
