The Director of Legal Affairs of the New Patriotic Party (NPP), Gary Nimako, has asked the National Democratic Congress (NDC) to abandon any plans to seek a review of the Supreme Court’s decision that quashed the annulment of the Kpandai parliamentary election.

Speaking after the Supreme court’s 4–1 majority ruling, Mr. Nimako said the Supreme Court had spoken “emphatically” on the matter and made it clear that the Tamale High Court acted without jurisdiction.

“I think that the Supreme Court has spoken emphatically that the decision by the Tamale High Court was made without jurisdiction, and so the court has ruled it out. Honourable Nyindam still remains the MP for the people of Kpandai, and his position has been maintained,” Mr. Nimako stated.

The Supreme Court on Wednesday, set aside the High Court judgment that nullified the election of Matthew Nyindam as Member of Parliament for Kpandai and ordered a rerun.

The apex court granted an application for certiorari filed by Mr. Nyindam, holding that the election petition was filed outside the constitutionally mandated 21-day period.

Commenting on suggestions that the NDC could apply for a review of the decision, Mr. Nimako dismissed the move as futile, arguing that the numerical composition of the ruling made any such attempt meaningless.

“It was a 4–1 decision, and they want a review? Review they will add two, so the four will not change the position. At best, it will be four against three, so I think the NDC should just forget about it,” he said.
