Private Legal Practitioner, Maurice Ampaw says Justice Abduali will suffer unprecedented defeat and disgrace with his decision to review the Supreme Court’s decision on the voting rights of Deputy Speakers of Parliament.

Justice Abdulai, a private legal practitioner sought for the Supreme Court’s interpretation on the voting rights of Deputy Speakers of Parliament when presiding.

In a unanimous decision of the seven-member panel, authored by Justice Yonny Kulendi, the court held that the 1992 Constitution does not place any restriction on a Deputy Speaker from being part of the quorum for decision making, and to vote on matters for determination.

It was the considered view of the court that Deputy Speakers were Members of Parliament (MPs) elected as representatives of constituencies, and therefore causing them to lose their casting vote would amount to disenfranchising their constituents in Parliament.

After the interpretation by the court, Justice Abdulai has said he will go for a review.

He claimed the unanimous ruling on the interpretation of Articles 102 and 104 of the 1992 Constitution of Ghana by the highest court of the country was not definite on the Deputy Speakers’ casting vote when the need arose on the floor of the House.

Reacting to his position, Lawyer Maurice Ampaw stated, “Justice Abdulai is my junior and I want to tell him this, yes when he sought for interpretation the first time I applauded him because he helped parliament and the entire country in getting clarity. I also advised him not to seek review after the judgment because I know he will be disgraced further. He refused my advice and has now gone to support Sammy Gyamfi and Mahama. Now if he has decided to go for a review, he must know that there will be just two new judges present and that means he has been defeated already. Even if he gets the votes of the two new judges the results will be 7-2.”

In an interview with Sefa-Danquah on the Happy98.9FM’s Epa Hoa Daben political talk show, Lawyer Maurice Ampaw emphatically stated that Justice Abdulai’s review will be futile. To him the previous judgement was sound and any lawyer knows that.
