The Deputy Attorney-General and Deputy Minister for Justice, Dr. Justice Srem-Sai, has announced that the ECOWAS Court of Justice has dismissed an application filed by Former Chief Justice, Mrs Gertrude Torkornoo, seeking interim measures in a case before the court.
In a statement issued on his official Facebook page on Wednesday, November 19, Dr. Srem-Sai said the regional court declined the request because it failed to meet the criteria required for the grant of interim or provisional measures.
According to excerpts of the ruling he shared, the ECOWAS Court held that “the Applicant’s own conduct defeats her claim of imminent and irreparable harm.”
The Court noted that the application was submitted nearly three months after the alleged act complained of, undermining the claim of urgency.
The ruling further stated:
“In the light of the Applicant’s failure to meet the requirement of urgency, the Court finds no basis to assess the remaining criteria for provisional measures, same being cumulative.”
The Court concluded that the request for provisional measures had not been substantiated and therefore dismissed it entirely.
