Election 2024: Editor of the Hawk Newspaper challenges Electoral Commission' approval of some political parties

The Editor of Hawk Newspaper, Charles McCarthy is set to take legal action against the Electoral Commission of Ghana for its decision to accept and approve the nomination forms of presidential candidates of some political parties.

In an interview with Kwadwo Sefah-Danquah on the Happ Morning Show, the editor challenged the Electoral Commission to annul other political parties in accordance with Article 55 clause (3) (4) (7) and (9) of the 1992 constitution with the exception of NPP and NDC.

According to him, the other political parties apart from NPP and NDC do not meet the statutory requirements of what constitutes a political party under the laws of the Republic and inclusion of these political parties violates the provision set out under Article 55 (4) of the constitution as they failed to meet the necessary criteria for recognition as political parties.

Also, the supposed political parties cleared by the EC were not able to satisfy the requirements of Article 55 (3) as they do not demonstrate the organisational structure required to function as political parties because they lack the requisite national, Regional and constituency officers as provided under Article 33(9) which mandates the proper and legal functioning of political parties in Ghana.

He further indicated that the Electoral Commission should remove the names of political parties he describes as amorphous from the list if they do not open their offices across the country, conduct National Executive elections, organize Congress to elect their leaders as mandated by the constitution.
