The High Court in Accra has issued a final warning to Nana Appiah Mensah (NAM1), CEO of Menzgold Ghana Limited, urging him to open his defense in the ongoing criminal case.

During proceedings on Thursday, July 17, 2025, Justice Ernest Owusu-Dapaa cautioned NAM1 over repeated lateness and delays.

The court directed him to submit witness statements by July 24, 2025, or be compelled to present his defense orally (viva voce).

Justice Owusu-Dapaa clarified that the trial would continue without prejudice to NAM1’s constitutional right to a fair hearing, noting that several pending applications at the Supreme Court would not obstruct progress in the High Court.

A prior directive from July 11, 2024, had already instructed NAM1 and other accused persons to file witness statements should they wish to mount a defense.

“In the circumstances, I direct the accused persons to open their defense by initially filing necessary witness statements or elect to testify directly viva voce at the next adjourned date,” Justice Owusu-Dapaa stated.

The case has now been adjourned to July 24, 2025.

If NAM1 fails to meet the deadline, his witnesses must be ready to testify in court that day.
