Chief Justice finds no prima facie case in petitions to remove EC, deputies and Special Prosecutor

The Chief Justice, Justice Paul Baffoe-Bonnie, has determined that petitions seeking the removal of the Electoral Commissioner, her deputies and the Special Prosecutor do not establish a prima facie case to warrant further investigations.

In a statement issued and signed by Felix Kwakye Ofosu, Spokesperson to the President and Minister for Government Communications on Wednesday, February 18, 2026, it was disclosed that seven petitions had been submitted for the removal of the Chairperson of the Electoral Commission and her deputies, while three separate petitions sought the removal of the Special Prosecutor.

In line with Article 146 of the 1992 Constitution and Section 15 of the Office of the Special Prosecutor Act, 2017 (Act 959), President John Dramani Mahama referred the petitions to the Chief Justice on November 25, 2025, to determine whether they disclosed a prima facie case.

In a letter dated January 26, 2026, the Chief Justice informed the President that the petitions did not meet the threshold required to trigger further action for the removal of the Electoral Commissioner, Deputy Commissioners and the Special Prosecutor.

The development effectively brings the removal process to a halt, as the establishment of a prima facie case is a constitutional requirement before any investigative committee can be set up to probe such petitions.
