High Court judge erred by revoking judgment on Afoko’s case – Lawyer

Member of the communication and legal team of the National Democratic Congress (NDC), Abraham Amaliba, has lamented over what he says is the injustice Gregory Afoko has suffered in the hands of the state.

Amaliba is of the opinion that the High court judge erred by revoking the earlier decision of the same court.

Gregory Afoko has been standing trial for allegedly killing the Upper East Chairman of the governing New Patriotic Party (NPP), Adams Mahama.

Although he has been granted bail by a judge in March and meeting all conditions set, the State has refused to release Mr. Afoko and has asked a different court to reverse the bail order.

On Happy FM’s ‘Epa Hoa Daben Show’, Amaliba said, “The decision to revoke the bail granted by the same high court but differently constituted was wrong because the high court itself had already made the order and there was a stay of execution and that stay was refused and then they went ahead to file an appeal and the appeal was still pending on that matter. So from the narration, the judge erred in doing what she did,” he said.

An Accra High Court presided over by Court of Appeal Judge sitting with additional responsibility as a High Court Judge, Justice Merley Afua Wood, on Monday rescinded the bail granted to Gregory Afoko on March 14 by Justice George Buadi’s Court after the State made an oral application to that effect in Court today, the 15th of July 2019.
Afoko was admitted to bail in the sum of ¢500,000 with two sureties, one of which must be justified.

As part of the bail conditions, the court presided over by Mr. Justice George Buadi, also ordered Afoko to report himself to the Criminal Investigations Department (CID) of the Ghana Police Service every two weeks.
