Dispute erupts between TVHA LBG and Empire Builders over estate security infrastructure

The Trasacco Valley Homeowners Association (TVHA) has issued a stern warning to Empire Builders, urging them to desist from interfering with the management of the Estate’s installation of automatic boom barriers at certain entrances of Trasacco Valley Phase 1. This move aims to enhance security and improve the collection of Estate Management Fees.

In an executive meeting, the TVHA Homeowners Association LBG who has managed the estate for the past 18 years, agreed to install barrier arm gates, also known as automatic boom barriers, at specific entrances. However, Empire Builders, in a letter dated October 1, 2024, claimed ownership of the common areas within the estate, stating that any development by the association requires their approval.

In an interview with happyghana.com, the TVHA executives responded, citing a Supreme Court ruling from December 16, 2020, between Empire Builders Limited, Topkings Enterprise LTD, and four others. This ruling established that Empire Builders Limited is no longer the legal owner of the common areas, thereby invalidating their claim.

According to the association, the common areas are appurtenant to the properties originally sold to their members by Empire Builders and also the expiration of the Declarant period. This assertion reinforces the TVHA’s right to proceed with the installation.

Despite this clarification, Empire Builders Limited has deployed private security personnel to the various entrances of the estate to frustrate the installation of the barriers. The TVHA executives are calling on Empire Builders Limited to withdraw their private security and allow the smooth installation to proceed.

The association emphasizes that Empire Builders’ actions are unjustified and urge them to respect the legal rights of the homeowners. The TVHA LBG remains committed to enhancing the security and well-being of its members and will take legal necessary steps to ensure the successful installation of the automatic boom barriers.
