Nii Tackie Commey, Spokesperson of George Tackie Abia (Nii Adama Latse II), one of the claimants to the Ga Stool has said they feel vindicated that their long held view that Nii Adama Latse II is the rightful Ga Mantse of the Ga Traditional Area has been affirmed by the court.
The court in February had granted an interlocutory injunction restraining the induction of George Tackie Abia as Ga Mantse following a suit by Nii Dr. Tetteh Kwei II and Nii Agyemang Kese II challenging his eligibility and installation.
They had argued that the recommendation, endorsement and forwarding of the Chieftaincy Declaration (CD) Forms of George Tackie Abia to the Greater Accra Regional House of Chiefs (GARHC) for his name to be gazette in the National Register of Chiefs as Ga Mantse was null and void as the Ga Traditional Council and Nii DodooNsaki II (1st and 2nd defendants/applicants) had no capacity to do so.
The plaintiffs averred that they were the accredited kingmakers of the Ga Paramount Stool and thus Nii Nsaki and the Ga Traditional Council “have no capacity to recommend, endorse or forward the chieftaincy declaration forms of George Tackie Abia to the Greater Accra Regional House of Chiefs.’’
They also prayed a declaration that the recommendation by the council to the National House of Chiefs for George Tackie Abia to be gazetted as the Ga Mantse is “fraudulent.’’
But George Tackie Abia filed an instant application to set aside the interlocutory injunction on the grounds that the plaintiffs misled the court by not disclosing certain important facts when they applied for the interlocutory injunction.
At a court sitting on November 16th, 2017, His Lordship Justice Kweku T. Ackaah-Boafo granted the instant application as he ruled that the interlocutory injunction, the plaintiffs’ writ of summons together with the statement of claim be set aside and further awarded cost of GHC 2,500 to the defendant.
According to the ruling, the plaintiffs had deliberately withheld critical information regarding the writ; the 3rd defendant (George Tackie Abia) had already been gazetted and included in the National Register of Chiefs in Kumasi.
On the allegations of fraud, His Lordship Justice Ackaah-Boafo said the plaintiffs could file a suit at the National House of Chiefs in Kumasi since the matter lies within the jurisdiction.
Speaking to Ghanaweb, Nii Tackie Commey said the induction of Nii Adama Latse II is now certified.
