Adu-Boahene and Wife sue AG, EOCO over bail

The High Court is set to deliver its ruling on the bail application filed by lawyers representing Kwabena Adu-Boahene, former Director-General of the National Signals Bureau (NSB), and his wife, Angela Adjei Boateng.

The couple remains in custody, contesting what their defense team describes as “unjustifiably harsh” bail conditions imposed by prosecutors.

The case, which lists the Attorney-General and the Economic and Organised Crime Office (EOCO) as respondents, has sparked debate over the constitutional limits on detention. Adu-Boahene’s legal team argues that the bail demands GH¢120 million for him and GH¢80 million for his wife, are excessive and designed to prolong their detention beyond the legally permitted 48-hour period without trial.

“The Respondents with a clear motive to incarcerate the Applicants beyond the 48-hour period as spelt out by the Constitution have imposed burdensome and unreasonable conditions on the Applicants as the precondition for their granting them bail,” the defense team stated.

The lawyers further claim that the bail conditions infringe on their clients’ rights, describing the move as a violation of their liberty.

They also accuse the state of obstructing due process by denying proper legal counsel and fair treatment.

“The justification of the bail is at the pleasure of the Respondents,” they stated, calling the move a blatant violation of their clients’ right to liberty. They further accused the state of denying them proper legal counsel and obstructing due process”.
